Beneficiary Designations: Pitfalls and Considerations 

Clients are accumulating wealth in retirement and investment accounts as a greater percentage of their estates than ever before. It is vital to review client beneficiary designations for both appropriateness and effectiveness. We will review issues related to naming trusts as beneficiaries of retirement accounts, and using the correct language to preserve the "stretch" distribution of retirement accounts. We will also discuss issues related to disabled beneficiaries, spendthrift beneficiaries and minors. There will also be a review of post-death considerations, such as distributing accounts post-death with proper account titling and for non-retirement investment accounts, the correct basis.
